Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you ("you", "your", "User") and CAREERSFORYOU LIMITED, a company incorporated in England and Wales (company number 16384492), trading as Cafy ("Cafy", "we", "us", "our"), with registered office at 25 Cumbrae Gardens, Salford, England, M5 5DZ, United Kingdom.

By creating an account, accessing, or using cafy.careers and any related services (the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. ELIGIBILITY

1.1 You must be at least 16 years old to use the Service.
1.2 You must have the legal capacity to enter into a binding contract under the laws of England and Wales.
1.3 You agree to provide accurate, current, and complete information during registration and to keep it updated.

2. ACCOUNTS

2.1 You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
2.2 You must notify us immediately at admin@cafy.careers if you become aware of any unauthorised access.
2.3 We may suspend or terminate your account if you breach these Terms or if we suspect fraudulent or unlawful activity.

3. THE SERVICE

3.1 Cafy provides an online job search and career platform designed for students and graduates seeking employment in the United Kingdom. Features include but are not limited to:

Sponsorship-verified job listings
CV creation, tailoring, and analysis
Cover letter generation
Job tracking dashboard
LinkedIn profile optimisation
Access to career mentors (pay-per-session)

3.2 Features available depend on your subscription tier. See the Pricing page (cafy.careers/pricing) for the current breakdown.
3.3 We may modify, suspend, or discontinue any feature at any time with reasonable notice where practicable. Where a paid feature is materially reduced, we will offer a pro-rata credit at our discretion.

4. PRICING AND PAYMENT

4.1 The Service offers a free tier with limited usage and one or more paid subscription tiers. Current prices are displayed on the Pricing page and are inclusive of UK VAT where applicable.
4.2 Paid subscriptions are billed in advance on a recurring basis (monthly or quarterly, depending on the plan you select).
4.3 All payments are processed by Stripe Payments Europe Ltd. By submitting payment details, you authorise us (via Stripe) to charge the applicable fee to your chosen payment method.
4.4 We may change subscription prices with at least 30 days' notice. Price changes apply at your next renewal. You may cancel before the renewal date if you do not accept the new price.

5. INSTANT ACCESS AND WAIVER OF COOLING-OFF RIGHT

5.1 Cafy is a digital service that begins delivery immediately upon payment.
5.2 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you would ordinarily have a 14-day cooling-off period during which you could cancel for any reason.
5.3 By clicking "Start Premium" (or equivalent) at checkout, you EXPRESSLY CONFIRM that:

(a) you want immediate access to the full Service from the moment of payment; AND
(b) you ACKNOWLEDGE AND WAIVE your statutory 14-day cooling-off right.

5.4 Because the Service is provided in full from the moment of payment, no refunds are payable once your subscription has started. See Section 6.

6. REFUNDS

6.1 Subject to your statutory rights, all paid subscriptions are non-refundable once access has commenced.
6.2 If you believe you were charged in error, or if a significant technical failure prevented you from using a material part of the Service, contact admin@cafy.careers within 14 days of the charge. We will review your case and may, at our discretion, offer a credit or partial refund.
6.3 Career mentor sessions are non-refundable once booked. You may reschedule a session up to 24 hours before its scheduled start at no charge. Cancellations within 24 hours forfeit the session fee.
6.4 Nothing in these Terms affects your statutory rights as a consumer under UK law, including (where applicable) the right to remedies if the Service is not as described, not provided with reasonable care and skill, or not fit for purpose.

7. CANCELLATION

7.1 You may cancel your subscription at any time from your account settings (Subscription → Cancel Plan). Cancellation is one-click and does not require email, phone, or chat contact.
7.2 When you cancel, your paid access continues until the end of the current billing period. After that, your account automatically reverts to the free tier and no further charges will be made.
7.3 Career mentor sessions already booked may be honoured or refunded at our discretion after cancellation.

8. ACCEPTABLE USE

You agree NOT to:
8.1 Use the Service for any unlawful purpose;
8.2 Misrepresent your identity, qualifications, immigration status, or work eligibility on any document, profile, or application generated through the Service;
8.3 Scrape, copy, or redistribute Cafy's job data, sponsor database, or any other content;
8.4 Reverse engineer, decompile, or attempt to extract source code of any part of the Service;
8.5 Use bots, automated tools, or other means to access the Service in a manner that exceeds normal human use;
8.6 Submit content that is unlawful, defamatory, harassing, or infringes any third-party rights;
8.7 Use the Service to send unsolicited communications;
8.8 Share, sell, or otherwise transfer your account to another person.

9. USER CONTENT

9.1 "User Content" means any data you upload to or generate using the Service, including CVs, cover letters, application records, and notes.
9.2 You retain all ownership of your User Content.
9.3 You grant us a non-exclusive, worldwide, royalty-free licence to host, process, and display your User Content solely to provide the Service.
9.4 We use AI tools to generate, analyse, and improve documents. By using these features, you understand that AI output may contain errors and that you are responsible for reviewing and verifying any document before submitting it to an employer.
9.5 We may use anonymised, aggregated data derived from User Content to improve the Service. We will not use identifiable User Content to train third-party AI models without your explicit consent.

10. INTELLECTUAL PROPERTY

10.1 All intellectual property in the Service (including software, designs, branding, content, and the sponsor database) belongs to Cafy or its licensors.
10.2 You may use the Service only as expressly permitted by these Terms.
10.3 Nothing in these Terms transfers any intellectual property rights to you.

11. THIRD-PARTY SERVICES

11.1 The Service integrates with third-party platforms (including but not limited to LinkedIn, Stripe, and Google). Your use of those platforms is subject to their own terms.
11.2 We are not responsible for the availability, content, or practices of third-party services.

12. NO EMPLOYMENT, LEGAL, OR IMMIGRATION ADVICE

12.1 Cafy is a job search and career tool. It is not a recruitment agency, law firm, or regulated immigration adviser.
12.2 Nothing on the Service constitutes legal, financial, employment, or immigration advice. UK immigration advice is regulated by the Immigration Advice Authority (IAA). For regulated advice, consult a qualified immigration adviser.
12.3 Cafy does not guarantee any job interview, job offer, visa sponsorship, or specific career outcome.

13. CAREER MENTOR SESSIONS

13.1 Career mentors are independent contractors and are not employees of Cafy.
13.2 Mentors provide general career guidance based on their personal experience navigating the UK job market.
13.3 Mentor sessions are not a substitute for regulated legal, immigration, financial, or psychological advice.
13.4 Cafy is not liable for the content of any mentor session or for any decision you make based on mentor guidance.

14. DISCLAIMERS

14.1 The Service is provided "as is" and "as available" without warranties of any kind, express or implied, except as required by law.
14.2 We do not warrant that the Service will be uninterrupted, error-free, or that all job listings or sponsor data will be accurate at the moment you view them. We use commercially reasonable efforts to keep data fresh and to verify sponsor status against the Home Office Register of Licensed Sponsors.

15. LIABILITY

15.1 Nothing in these Terms limits our liability for:

(a) death or personal injury caused by our negligence;
(b) fraud or fraudulent misrepresentation;
(c) any other liability that cannot be limited under UK law.

15.2 Subject to clause 15.1, our total aggregate liability to you under or in connection with these Terms shall not exceed the total amount you have paid to Cafy in the 12 months preceding the event giving rise to the claim.
15.3 We are not liable for any indirect, consequential, or special losses, including loss of earnings, loss of job opportunities, or loss of data.

16. TERMINATION

16.1 You may terminate these Terms at any time by cancelling your subscription and deleting your account.
16.2 We may terminate these Terms or suspend your account immediately if you materially breach these Terms.
16.3 On termination, your right to use the Service ends and we may delete your User Content after a reasonable retention period (see Privacy Policy for details).

17. CHANGES TO THESE TERMS

17.1 We may update these Terms from time to time. Material changes will be notified by email or in-app at least 14 days before they take effect.
17.2 Continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.

18. GENERAL

18.1 These Terms are governed by the laws of England and Wales.
18.2 Disputes are subject to the exclusive jurisdiction of the courts of England and Wales, except that consumers may bring proceedings in their country of habitual residence.
18.3 If any provision of these Terms is held unenforceable, the remainder shall remain in full force and effect.
18.4 No waiver by us of any breach shall constitute a waiver of any subsequent breach.
18.5 These Terms constitute the entire agreement between you and Cafy in relation to the Service.
